Maulid Mohamed is a Partner at KO Associates LLP and heads the Banking, Real Estate, and Construction (BREC) practice. He has extensive conveyancing, banking, and commercial law experience and has structured and advised on commercial transactions for various clients. Maulid has acted for various developers in property acquisitions and the development of housing projects. He has experience in strategic commercial litigation designed to drive his client’s business forward and considers legal services as a core part of the going concern. He has extensive experience in leading teams in his areas of practice which skill guarantees clients’ seamless service.

His experience extends to securitization having acted for various banks and financial institutions in the preparation and perfection of loan and security documentation, advisory on Legal audit and compliance, governance, Civic engagement, and institutional strengthening,  as well as advising on the formation of private, and public companies and unincorporated associations and in Commercial transactions such as drafting and review of Corporate Contracts and policies, shareholders Agreements, Loan Agreements and Non-Disclosure Agreements,

Transaction Highlights

• Reviewing and drafting various legal documents such as documentation for the sale and purchase of land and other forms of immovable property, variation and novation agreements, transfer of land and transfer of lease, applications for provisional titles, long term leases in respect of residential and commercial properties, charge and discharge documentation.
• Was a lead counsel in an environmental public interest litigation on behalf of residents of Liwatoni in Mombasa County, Kenya where he successfully challenged a USD 5 billion energy project that had failed to undertake adequate environmental impact assessments as by law required and would have had a grave impact on the residents, marine environment and surrounding habitats.
• Undertook in-depth due diligence for clients who wish to purchase property (including recommending ground surveys or survey check to be done) and coming up with a due diligence report on the findings
• Handling the change of user process on behalf of a client and liaising with the land clerks to ensure that the process is flowing smoothly from the PPA 2 and approval stage to the issuance of the government lease and finally issuance of title document by the Lands Registry
• Advising purchasers and developers in the sale and purchase of residential units within a development and ensuring that the developer clients’ interests are protected, and that the sale process runs smoothly from the letter of offer stage to registration of the long-term lease in favor of the purchaser and finally to the transfer of reversionary interest to the management company
• Preparing key documentation to facilitate the registration and renewal of leases for Safaricom.
• ATC Kenya lease registration and related services: The Project involves the registration of leases for American Towers Corporation Kenya for Base Transmission sites and ensuring legal compliance with the Land Act, Land Registration Act and other related legislations.
• Perfecting of Bank Securities for various financial institutions such as Equity Bank, National Bank of Kenya and Mwalimu Sacco, Consolidated Bank of Kenya including but not limited to preparation of the various Charge, Discharge, Debenture documents, negotiating terms of a professional and financial undertaking, obtaining necessary consents and securing subsequent registration.
• Provision of legal support in the audit of the leases to ensure compliance with the Land Act and Land Registration for ATC Kenya lease registration and related services
