Sectional Property Registration in Kenya: A Simplified Guide

In the last few years, Kenya has been in a state of fast-paced property registration and land management transformation. 

In 2020, the Sectional Properties Act No. of 2019 (“the Act”) was enacted to align with the Constitution and land laws in Kenya. Sectional property describes a property tenure where a person can have individual ownership of a unit within a development like offices and apartments. The Act made it easy to register titles in apartments, townhouses, office units amongst others. 

We now look at the process of registering sectional property: 

Registration of sectional units 

Step 1: Present mother title to Land Registry 

Step 2: Individual registers opened for each unit at a fee 

Step 3: Title deeds issued for individual units, including their share of common property 

Step 4: Formation of management corporation for supervision of the common areas of property. 

Points to note: 

  • The Management Corporation can form a dispute resolution committee to hear and determine disputes between unit owners. 
  • The ownership rights of sectional titles offer the same rights as traditional property owership held by unit owners
